Expunge your Drug Crime Arrests

If you have a drug crimes conviction on your record, you may be eligible for an expungement.  Expungement refers to the process of setting aside a conviction or plea of “guilty” or “no contest” and dismissing the case.  In order to be granted an expungement, you must:

  • Fulfill all of the terms of your probation, or
  • Have been discharged from the original terms of your probation, or
  • Not have been placed on probation; and
  • Have completed all the terms of your sentence; and
  • You were not incarcerated in state prison (there are some exceptions)

In addition, expungement is very useful for people with felony convictions on their record.  Through expungement, a person can petition to have their felony reduced to a misdemeanor.   Since California has the three strikes law, expunging a criminal record is imperative for anyone facing charges for a second or third felony.  Under the three strikes law, a person convicted of a second serious or violent felony will face double the penalties, and anyone convicted of a third felony will automatically be sentenced to 25 years to life in prison.  An expungement can help a defendant with a prior criminal history avoid this.
